Welcome to BlastCaster. These Terms of Service govern your access to and use of blastcaster.us, our products, content, checkout, customer-support channels, and related services (collectively, the “Services”).

By browsing the website, placing an order, completing checkout, submitting content, or otherwise using the Services, you agree to these Terms. These Terms also incorporate our Privacy Policy, Return and Refund Policy, Shipping Policy, product descriptions, instructions, and checkout disclosures.

If you do not agree, do not use the Services or purchase from us. Nothing in these Terms limits a consumer right that cannot legally be waived.

1. Store Information and Eligibility

The Services are operated by BlastCaster from Ontario, Canada. “BlastCaster,” “we,” “us,” and “our” refer to the store operator and authorized personnel. “You” and “your” refer to any visitor, customer, purchaser, cardholder, recipient, or person acting for a purchaser.

You must have legal capacity to enter a binding agreement. If you have not reached the age of majority where you live, you may use the Services only with the permission and supervision of a parent or legal guardian.

If you use the Services for a business or another person, you represent that you have authority to bind that person or business to these Terms.

2. Product Description and Expectations

BlastCaster is a compact fishing rod and casting device intended to help launch suitable fishing line, bait, or lures, including in locations where a conventional full-size casting motion may be difficult. Features and included components may vary by model.

Before ordering, customers must review the complete product description, dimensions, included parts, assembly instructions, compatible equipment, intended use, safety information, and shipping information. A feature or accessory shown for one version is not automatically included with every version.

Unless the product page expressly says otherwise:

• customer assembly, adjustment, and setup may be required;

• fishing line, hooks, bait, lures, reel, or other tackle may not be included;

• compatible third-party fishing equipment may be required;

• casting distance and accuracy depend on the selected setup, environment, and user technique; and

• the product is not defective merely because assembly, adjustment, practice, instruction-following, or reasonable troubleshooting is required.

Images and videos are illustrative. Actual colour, finish, dimensions, packaging, accessories, casting distance, and minor manufacturing details may vary because of lighting, camera settings, user technique, tackle choice, weather, supplier updates, and reasonable manufacturing tolerances. Minor variations that do not materially prevent the product from functioning as described do not make it defective.

3. Fishing Laws, Locations, and Third-Party Equipment

Customers are responsible for knowing and following all fishing, wildlife, environmental, licensing, access, property, public-safety, and equipment rules that apply where the product is used.

Purchasing BlastCaster does not include a fishing licence, permission to enter private property, permission to fish in a restricted area, or authorization to use prohibited bait, hooks, lures, line, or casting methods.

You are responsible for choosing lawful and suitable tackle and for verifying that third-party rods, reels, line, hooks, lures, bait, weights, and accessories are compatible and safely installed.

BlastCaster does not control or endorse third-party equipment merely because it appears in a demonstration. We are not responsible for damage or injury caused by unsuitable, defective, overloaded, incorrectly attached, or improperly used third-party equipment.

4. Product Safety and Proper Use

Use BlastCaster safely, lawfully, responsibly, and only as instructed. Fishing hooks, lures, line, tensioned components, and launched objects can cause serious injury or property damage.

Never aim, cast, or launch toward people, animals, vehicles, buildings, windows, power lines, boats, occupied areas, or any place where the line, hook, lure, bait, or device could create danger.

Inspect and properly secure all components before each use. Keep fingers, face, hair, loose clothing, and bystanders away from hooks, line, tensioned parts, moving components, and the launch path.

Do not overload the device, use damaged components, exceed a suitable lure or weight range, modify the product, use it as a weapon, or allow unsupervised children to operate it. Use eye protection and other reasonable safety equipment where appropriate.

Stop using the product if the rod, reel, line, trigger, launcher, fasteners, housing, or other components become cracked, bent, loose, worn, tangled, unstable, or otherwise unsafe.

To the extent permitted by law, we are not responsible for harm caused by unsafe casting, improper assembly, failure to follow instructions, unsuitable tackle, overloading, unauthorized modification, use in a prohibited location, or use for an unintended purpose.

5. Equipment Compatibility and Performance

We do not guarantee compatibility with every rod, reel, line, hook, lure, bait, weight, connector, or third-party accessory.

Casting distance, direction, accuracy, and performance vary with product version, assembly, line condition, reel settings, lure or bait weight, wind, weather, user technique, maintenance, and operating environment.

We are not responsible for tangled or broken line, lost hooks or lures, unsuitable tackle, incorrect reel settings, customer assembly errors, corrosion caused by inadequate care, or damage caused by sand, salt, water, impact, or weather beyond the product's intended tolerance.

Before claiming a defect, you may be required to inspect and reassemble the product, confirm suitable line and tackle, adjust the reel or launcher, follow published instructions, provide photographs or video, and complete reasonable troubleshooting. Refusing reasonable troubleshooting may prevent us from verifying the issue.

6. Accuracy of Website Information

We try to present accurate descriptions, prices, images, availability, promotions, and shipping information. However, content may occasionally include typographical, technical, pricing, availability, supplier, formatting, or other errors.

We may correct errors, update information, change prices, clarify descriptions, limit quantities, substitute substantially equivalent packaging or components, or cancel an order affected by an obvious error. If a material error affects an accepted order, we will provide an appropriate remedy where required by law.

We are not required to honour an obviously incorrect price, accidental discount, or technical malfunction where doing so would be unreasonable or unlawful.

7. Orders and Acceptance

Submitting an order is an offer to purchase. An automated confirmation only acknowledges receipt and does not necessarily mean the order has been accepted or shipped.

Unless applicable law provides otherwise, an order is accepted when fulfillment begins, a fulfillment confirmation is sent, or the product ships.

We may reject, hold, investigate, limit, or cancel an order because of suspected fraud, payment or identity concerns, inaccurate information, pricing errors, unavailability, shipping restrictions, legal restrictions, policy abuse, unlawful content, unsafe intended use, or failure to provide requested verification.

If we cancel after successfully collecting payment, we will issue the refund required by applicable law and our policies.

8. Pricing, Payment, and Fraud Prevention

Prices are shown in the currency displayed at checkout and may change without notice. Taxes, customs charges, duties, brokerage, conversion fees, or optional charges may apply depending on your location.

By ordering, you authorize us and our payment providers to charge the payment method provided for the complete checkout total. You agree to provide accurate, current, and complete billing, shipping, contact, and payment information and represent that you are authorized to use the payment method.

We may use lawful fraud-screening, address verification, payment authentication, device information, IP information, order history, and delivery information to evaluate transaction risk. Orders may be held or cancelled when payment is declined, reversed, disputed, unauthorized, incomplete, or flagged as high risk.

Payment Disputes and Chargebacks

If you believe there is a problem, contact blastcastersupport@gmail.com before opening a chargeback so we have a reasonable opportunity to investigate.

A chargeback does not automatically cancel an order, establish entitlement to a refund, remove return obligations, or permit duplicate reimbursement. Where permitted, we may contest a dispute and provide relevant evidence to authorized payment processors, banks, card networks, fraud-prevention services, carriers, insurers, platforms, or legal advisers.

Evidence may include order and payment records, checkout acceptance, billing and shipping information, fraud-screening results, device and session information, applicable product descriptions, customer-submitted photographs or videos, fulfillment records, shipping labels, tracking, delivery evidence, support communications, troubleshooting records, and completed refunds or replacements.

We may pause a voluntary refund, replacement, or investigation while a dispute about the same transaction is active to prevent duplicate reimbursement. Nothing in this section prevents a legitimate exercise of a non-waivable payment or consumer right.

9. Shipping and Delivery

Processing, fulfillment, shipping, and delivery dates are estimates unless expressly guaranteed in writing. Our target delivery estimate is generally 6–10 business days after fulfillment, but processing time before fulfillment is separate.

Delivery may take longer because of order volume, supplier or production delays, carrier delays, customs, import restrictions, holidays, weather, emergencies, labour disruptions, incorrect addresses, failed attempts, inaccessible locations, or unpaid import fees.

A delayed scan, customs delay, missed estimate, or temporary absence of tracking updates does not by itself mean that an order is lost.

You are responsible for providing a complete, accurate, and deliverable address and for monitoring tracking and responding to carrier or customs requests. Carrier scans, photographs, signatures, geographic data, customs records, and communications may be used as evidence of shipment, attempted delivery, or delivery.

10. Returns and Refunds

Returns, refunds, replacements, cancellations, damaged-order claims, EU withdrawal requests, and return-shipping responsibilities are governed by our Return and Refund Policy.

Submitting a request does not mean it is approved. Approval must be confirmed by BlastCaster Support or required by law. Do not return an item to the original sender address, shipping-label address, or an address found online unless support specifically provides that address for the approved return.

11. Prohibited Uses

You may not use the Services:

• for an unlawful, fraudulent, harmful, or abusive purpose;

• to infringe intellectual-property, privacy, publicity, contractual, or other rights;

• to impersonate another person or submit false or misleading information;

• to use a payment method without authorization;

• to obtain duplicate refunds, products, credits, or reimbursements;

• to interfere with security, bypass controls, scrape, crawl, hack, reverse engineer, or overload the website;

• to introduce malware, bots, spam, or harmful code;

• to harass, threaten, defame, exploit, or harm another person;

• to counterfeit, imitate, resell deceptively, or misrepresent our products or branding; or

• to falsely suggest an affiliation with BlastCaster.

We may restrict access, cancel orders, preserve evidence, refuse future service, or take other reasonable action when these Terms are violated.

12. BlastCaster Intellectual Property

Unless otherwise stated, our name, logos, original text, photographs, graphics, designs, videos, branding, layouts, advertisements, instructions, policies, website code, and promotional materials are owned by or licensed to BlastCaster.

You may not copy, modify, republish, distribute, sell, imitate, scrape, commercially exploit, or create commercial derivative materials from protected content without written permission. Purchasing a product does not transfer ownership of our branding, website content, marketing materials, or product photography.

13. Third-Party Services and Links

The Services may use or link to Shopify, payment providers, banks, carriers, customs authorities, analytics tools, advertising platforms, social networks, cloud services, and other third parties.

We do not control third-party services and are not responsible for their content, security, availability, policies, delays, errors, or decisions. Your use of them may be governed by separate terms, fees, licences, compatibility requirements, and privacy policies.

14. Limitation of Liability

To the maximum extent permitted by law, BlastCaster and its owners, personnel, contractors, suppliers, fulfillment partners, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profit, revenue, opportunity, savings, data, files, devices, or business interruption.

To the maximum extent permitted by law, our total aggregate liability relating to an order will not exceed the amount paid to BlastCaster for the specific product giving rise to the claim.

These limits do not apply where liability cannot legally be excluded or limited. In jurisdictions that restrict exclusions, the limitations apply only to the maximum extent permitted.

15. No Guarantee

We do not guarantee uninterrupted website access, exact delivery dates, permanent product availability, exact colour matching, a specific casting distance or accuracy, compatibility with every rod, reel, line, lure, hook, bait, or accessory, uninterrupted third-party services, or suitability for an undisclosed purpose.

Any specific guarantee must be expressly stated in writing by authorized BlastCaster Support.

16. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless BlastCaster and its owners, personnel, contractors, suppliers, fulfillment partners, service providers, and affiliates from third-party claims, losses, liabilities, penalties, judgments, and reasonable costs arising from your misuse of the product, violation of these Terms or applicable law, infringement of another person’s rights, unauthorized payment use, fraudulent claims, unsafe casting, use in prohibited areas, unsuitable tackle, or unauthorized modification.

This obligation does not apply to the extent a claim was directly caused by our unlawful conduct or where indemnification is prohibited by law.

17. Governing Law and Disputes

These Terms are governed by the laws of Ontario and applicable federal laws of Canada, without regard to conflict-of-law rules, unless mandatory law in another jurisdiction must apply.

Before starting formal proceedings, the parties should make a reasonable attempt to resolve the matter in writing. Nothing in these Terms requires a consumer to waive access to a court, tribunal, regulator, payment process, or remedy that cannot legally be waived.

18. Changes to These Terms

We may update these Terms for operational, product, platform, fraud-prevention, legal, regulatory, or clarity reasons. The revised version will be posted on blastcaster.us with a new “Last updated” date.

Changes generally apply to future use and future orders. Terms applicable to an existing order will generally be those presented when it was placed, except when a later change is required by law, expressly accepted, or otherwise legally applicable.

19. Severability and No Waiver

If a provision is invalid or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue to apply.

Our failure to enforce a provision does not waive it. Approval of an exception, refund, replacement, or cancellation in one case does not require the same result in another case.

20. Entire Agreement

These Terms, together with our Privacy Policy, Return and Refund Policy, Shipping Policy, Contact Information, applicable product description, instructions, checkout disclosures, and order confirmation, form the agreement between you and BlastCaster concerning the Services and your purchases.

They replace prior communications about the same subject except for a specific written commitment made by authorized BlastCaster Support. If a specific written product term conflicts with a general term, the more specific term applies to that issue unless prohibited by law.

Nothing in these Terms creates a partnership, employment, agency, franchise, joint venture, or fiduciary relationship between you and BlastCaster.
